These Terms of Service (“Terms”) govern your use of the website www.cateringmarbella.es (the “Site”) and the catering, event-planning and related services (collectively, the “Services”) provided by Catering Marbella, a company registered at Av. Ricardo Soriano 72, Portal B, 1st Floor, 29601 Málaga, Spain (“we”, “us” or “our”). By accessing or using the Site or booking our Services, you agree to be bound by these Terms.
By placing an enquiry or booking Services via the Site, by email to info@cateringmarbella.es or by any other means, you confirm that you have read, understood and accept these Terms in full. If you do not agree with these Terms, you must not use the Site or book our Services.
2.1 Scope. We offer bespoke catering, party planning, on-day coordination and ancillary services across Marbella, Sotogrande, Estepona and the wider Costa del Sol. All Services are subject to availability and must be confirmed in writing.
2.2 Quotation & Booking. We will provide a written quotation detailing your chosen menu, staffing, equipment hire and ancillary costs. To secure your booking, a non-refundable deposit (as specified on the quotation) must be paid no later than 14 days after receipt of the quotation. Full payment terms are set out in Clause 4.
3.1 You must provide accurate event details, including date, time, venue access requirements and guest numbers, at least 28 days prior to the event.
3.2 Any changes requested within 14 days of the event may incur additional charges and are subject to our discretion.
3.3 You are responsible for securing any necessary licences, permissions or permits (e.g. liquor licence, noise permits) unless expressly agreed otherwise in writing.
4.1 Deposit. A non-refundable deposit of 30 per cent of the total fee is due on booking.
4.2 Balance. The remaining 70 per cent is payable not later than 14 days before the event date.
4.3 Late Payment. We reserve the right to suspend or cancel Services if any amount remains outstanding 7 days past its due date.
5.1 By You. If you cancel more than 30 days before the event, you forfeit the deposit but incur no further charges. Cancellations made between 14 and 30 days before the event incur 50 per cent of the agreed fee. Cancellations within 14 days incur 100 per cent of the agreed fee.
5.2 By Us. We may cancel due to force majeure (including extreme weather, government restrictions, aggressive and rude behavior or supplier failure). In such cases, we will offer to reschedule or refund any sums paid.
6.1 We shall not be liable for any indirect, special or consequential loss, including loss of profit, goodwill, reputation or anticipated savings.
6.2 Our total aggregate liability arising from or in connection with your booking shall not exceed the total fees paid for the Services in question.
6.3 You indemnify us against any third-party claims arising from your breach of these Terms or your negligence.
All content on the Site, including text, graphics, logos, images, audio and video, is protected by copyright and other intellectual property rights. You may view and print material for your own personal, non-commercial use only. Any other use requires our prior written consent.
We process personal data in accordance with our Privacy Policy. By using the Site or booking our Services, you consent to such processing and warrant that all data provided is accurate.
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with Spanish law. The courts of Málaga shall have exclusive jurisdiction.
